Your privacy is important to TooD (“TooD,” “us,” “our,” or “we”) and we need to collect certain information to provide our services to you. Please read this Privacy Policy (“Privacy Policy”) to understand how TooD collects, uses, and/or shares your Personal Information (as defined below) when you visit, browse, and/or make a purchase from the TooD website located at https://www.toodbeauty.com/ and TooD-controlled social media pages (the “Service”).

1. PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT.
When you visit and/or use our Service, we may collect your Device Information (as defined below), Order Information (as defined below), and/or Contact Information (as defined below). Collectively, Device Information, Order Information, and Contact Information are “Personal Information.

(a) Device Information.
When you visit the Service, we automatically collect certain information that does not personally identify you but may uniquely identify the device you are using to visit the Service (e.g., your computer, tablet, or smartphone) (“Device”), including information about your web browser, your Device manufacturer, your operating system and version, general location information, and your time zone and language settings. Additionally, as you browse the Service, we collect information about the individual web pages or products that you view on the Service, what websites or search terms referred you to the Service, and information about how you interact with the Service. We refer to this automatically-collected information as “Device Information.

We and our Service Providers (as defined below) collect Device Information by setting cookies and other tracking technologies on the Service. For more information about cookies and other tracking technologies used on the Service, and your controls over their use, please review our Cookie Policy in Section 3 below.

How We May Use Your Device Information:
i. To help us screen for potential risk and fraud, in particular, by using your IP address.
ii. To measure, analyze, improve, and optimize the performance of our Service.  
iii. To show you ads about our products on third-party websites and applications.

(b) Order Information.
To make a purchase through the Service, you will be required to provide certain information so that we can complete your purchase, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as “Order Information.

How We May Use Your Order Information:
i. To send you invoices and/or order confirmations.
ii. To process your payment information and arrange shipment of your order.
iii. To communicate with you about your purchase.
iv. To administer promotions or giveaways that you have entered.
v. To screen our orders for potential risk or fraud.

(c) Contact Information.
When you use the Service, there are several opportunities for you to interact with us, such as by contacting us via the Contact Form, emailing us directly, or by commenting on one of our blog articles. When you do so, we may collect and use your name, email address, and any other information you voluntarily provide to us so that we can respond to you (“Contact Information”).

How We May Use Your Contact Information:
i. To respond to the questions and inquiries you sent to us.
ii. If you are a subscriber, to send you occasional marketing newsletters and other email updates about TooD (“Newsletters”). For instructions on how to opt-out of receiving Newsletters, please see Section 7.
iii. To administer promotions or giveaways that you have entered.
iv. To approve your comments and prevent spam if you are trying to comment on our blog articles.

2. SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES.

(a) Service Providers.
Like most companies, we use tools from third party service providers to help us with various parts of our business (“Service Providers”), and depending on the service we need, these Service Providers may have access to your Personal Information. For example, we use a Service Provider’s email software to manage our Newsletter subscriptions, and if you have given us your email address to subscribe to the Newsletter, then your email address will be shared with that Service Provider. We also use Service Providers for the following purposes:
i. To host the Service.
ii. To process your orders and payment information.
iii. To deliver emails and newsletters.
iv. To help us conduct web analytics on the Service.

All Personal Information shared with Service Providers will be to allow TooD to better provide the Service in compliance with the California Consumer Privacy Act (“CCPA”).  While the CCPA is required for only California residents, TooD treats all of its users equally and will apply the same protections of the Personal Information for all of its users.

We contractually require all Service Providers to treat your Personal Information as confidential information and to only use it for the services we need. However, we do not have direct control over how Service Providers use your Personal Information, and we cannot guarantee that our Service Providers will use your Personal Information as required in our contract with them. For this reason, we are not responsible for our Service Providers’ misuse of your Personal Information.

(b) Business Transfers.
As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of our assets are acquired, or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

(c) Legal.
We may disclose information you provide to respond to subpoenas, court orders, requests from authorities, and other legal processes, and to establish/exercise our legal rights. We may also disclose your information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

3. COOKIES AND OTHER TRACKING TECHNOLOGIES.

(a) What are Cookies?
We aren’t talking about chocolate chip here. A cookie is a small text file that is stored on your Device by a website you visit. Commonly, companies use cookies on their websites to identify visitors, to remember visitors’ preferences, to better understand how visitors use and interact with the website, and to keep visitors logged into their accounts while they navigate the website. Cookies are either first-party cookies, which belong to the domain you are visiting, or third-party cookies, which are set by and belong to a different domain than the one that you’re currently visiting.

(b) Your Control Over Cookies.
In some cases, a third party might give you the ability to opt-out of receiving their cookies. Please review the third party’s privacy policy and/or cookie policy for more information. You can also control how cookies are used by updating your browser settings to accept or refuse all or certain types of cookies. If you choose to reject certain cookies, please note that the Service and/or some of its features may not function properly. However, you can still place orders over the phone or by contacting customer service.

4. HOW IS MY PERSONAL INFORMATION USED FOR ANALYTICS?
As an online business, it is important for us to know how users interact with our Service. We and our Service Providers will collect your location information and Device Information so that we can deliver our Service to our users, measure, analyze, and improve performance of the Service, and to continually update and develop our Service. For example, we will use this information to fix any bugs or errors in the Services and to determine if we need to support a new Device type for the Service. 

5. HOW IS MY PERSONAL INFORMATION USED FOR ADVERTISING?
To help us keep our Service running, we show ads in our Service with the help of third-party advertising partners (“Ad Partner”). We integrate the Ad Partner technologies into our Service, which are then used by the Ad Partner to determine what kind of ads to display to you. 

(a) Does the Ad Partner Collect My Personal Information?
In order to show you ads that you might find interesting and/or relevant (“Targeted Ads”), the Ad Partner may collect and use your location information and Device Information. If location services are enabled in your Device settings, the Ad Partner may additionally collect your geolocation information. Because the Ad Partner’s technologies control what kind of personal information is collected from your Device and how it is used, we encourage you to review the Ad Partner privacy policies, found at https://policies.google.com/privacy?hl=en.

(b) How to Opt-Out of Receiving Targeted Ads.
If you do not want to receive Targeted Ads on your mobile Device, your mobile Device may give you the option to opt-out of receiving Targeted Ads on all apps on your Device. On Android Devices, you may opt-out by enabling the “Opt out of Ads Personalization” setting. On iOS Devices, you may opt-out by enabling the “Limit Ad Tracking” setting. In addition, you may be able to opt-out of receiving Targeted Ads from a specific Ad Partner by visiting the Digital Advertising Alliance’s opt-out portal at: http://optout.aboutads.info/ or through Google at https://adssettings.google.com/authenticated. Please note that if you opt-out of receiving Targeted Ads, you will still receive contextual ads, which are non-targeted ads related to the content of the Service.

6. DO NOT TRACK.
Please note that we do not alter our Service’s data collection and use practices when we see a Do Not Track signal from your browser.

7. OPTING OUT OF OR UNSUBSCRIBING FROM NEWSLETTERS.
If you wish to unsubscribe from receiving Newsletters, you can click on the “unsubscribe” link at the bottom of the email. Please allow up to 24 hours before you stop receiving Newsletters. You may also continue to receive emails unrelated to marketing.

8. THIRD PARTIES AND THEIR POLICIES.
Throughout the Service, you may see links to third-party websites or applications. We are not responsible for the privacy practices of these third-party sites, and when accessing their sites, we encourage you to read their privacy policies.

9. DATA RETENTION.
How long we store your Personal Information will depend on the purpose that we originally collected it. We will not retain Personal Information for longer than is necessary for our legitimate business interests or to comply with legal requirements. 10. SECURITY.
The security of your Personal Information is important to us. We follow generally accepted industry standards to protect your information, both during transmission and once it is received. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. While no security system is completely secure, we and our Service Providers take appropriate security measures to protect against unauthorized access or disclosure of the information collected by us.

11. SOCIAL MEDIA FEATURES.
The Website includes integrated social media features, such as sharing articles. These features may collect the email address you use for that social network. Social media features are hosted by that social media network and your interactions with these features are governed by the privacy policy and terms of use of that social media network.

12. MINORS.
The Service is not directed to children under the age of 13 and we do not knowingly collect information from children under the age of 13. If we learn that we have received any type of information from a child under the age of 13, we will delete such information. 13. ACCESSING, MANAGING, AND/OR UPDATING YOUR PERSONAL INFORMATION.
You can access, update, or correct some of your Personal Information directly in your account settings on the Service. If you cannot update your Personal Information in your account settings, please contact us at support@toodbeauty.com.

14. FOR CUSTOMERS IN THE EUROPEAN UNION.
If you are a European resident, you have the right to access Personal Information we retain and to ask that your Personal Information be corrected, updated, or deleted. You additionally have the right to receive a copy of the Personal Information we have about you. If you would like to exercise these rights, please contact us by emailing hello@toodbeauty.com.

Additionally, if you are a European resident, we note that we are processing your Personal Information in order to fulfill contracts we might have with you (for example if you make an order through the Service), or otherwise to pursue our legitimate business interests, such as direct marketing, to prevent fraud, and to conduct analytics on the Service. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. We rely on model contractual clauses and/or the Privacy Shield certification for such transfers.
